❮ Whoever fears that a testator has tilted away from fairness (janafan) or sinned (ithman), and reconciles between the parties, no burden rests upon him. God is Forgiving, Merciful. ❯
The fāʾ at the head of "fa-man" fastens this ruling to the ruling on altering a will in the verse just before it, so it opens a door of exception right after a narrowing: not everyone who steps into a bequest is an alterer carrying weight, for some stepping in is repair, and repair is rewarded. The nucleus kh-w is an inward stirring that senses, and the fāʾ of the root opens it onto something expected from outside that has not yet fallen; so fear in this tongue is an anticipation ahead of the event, not a shudder after it. "Min" in "min mūṣin" is explicative and not partitive: it fixes the source from which the flaw is expected. And the active participle mūṣin, from w-ṣ-y, is left indefinite so that it takes in everyone who fills the role of bequeathing, and not one named man.
The parting of "tilted away from fairness" from "sinned" is a parting at the root and not a figure of speech. The nucleus j-n is a hidden inward swerve, and the fāʾ opens it onto a leaning that shows in the deed; so janaf is a tilt that comes out of the testator without any aim to harm, as with one who favoured a child out of that child's need and did not attend to the right of another. As for ʾ-th-m, it has already passed that it is a load piling up out of deliberateness. And "aw" here sets out a variety and not a wavering: two states, and each one of them calls for the repairer to step in. So the repairer is required to tell the two apart before he moves, lest he handle the one who tilted as he would handle the one who sinned.
The fāʾ in "and reconciles" is a fāʾ of what comes straight after: the repair follows directly upon the sensing of the flaw, with no haste and no delay. The nucleus ṣ-l is a strength that holds firm, and the ḥāʾ opens it onto breadth; so iṣlāḥ at the root is the returning of a thing to a firm and roomy condition in which it can stand, and not an outward patching. The adverb "between" sets the deed in the space where the parties hold to one another, and not in the repairer's relation to the document by itself. And the plural pronoun in "between the parties" runs back to those who inherit and not to the testators, and that discloses that the repair falls upon the whole social web and not upon the written text alone.
The "lā" in "no burden rests upon him" negates the whole genus: it lifts every measure of ithm off the repairer, and not a portion of it. And "ʿalā", which recurred in the verse of alteration to carry the settling of a load, stays present here by way of the negation: the load never came to rest at all. Then the close is "God is Forgiving, Merciful" and not "Hearing, Knowing", and the divergence is meant. The alterer earns a close of surveillance; the repairer earns a close of covering and breadth. The nucleus gh-f is a thick cover that veils, and the rāʾ brings renewal and repetition; so ghafr is a cover made new over whatever mistaken reckoning may have come from the repairer himself. And the nucleus r-ḥ is a clinging amplitude, like the womb that gathers what is inside it, and the mīm seals the compacting.
So the word precedes the term and the role precedes the identity. The muṣliḥ is not a title but a role, fallen into by whoever saw a tilt or a deliberate leaning in a will and moved at once to bring it back to evenness, before a written injustice could settle on the backs of the heirs.
The verse before it opened the door of prohibition upon the alterer; this verse opens the door of exception with the branching fāʾ: not every stepping into a will is a forbidden alteration. The root kh-w-f here is an anticipation ahead of the event and not a shudder after it, and that is what gives the repairer his standing: he senses the flaw and moves before the will can settle as a written injustice. Then the two named defects, "tilted away from fairness" and "sinned", part two different kinds: janaf is an unintended tilt issuing from an inward inclination with no aim to harm, and ithm is a deliberate and laboured carrying. "Aw" sets out a variety and not a wavering, and the repairer is required to tell the two apart, lest he handle the one who erred as he would handle the one who sinned. The fāʾ of immediate succession in "and reconciles" puts the repair straight after the sensing, and the root ṣ-l-ḥ carries the returning of a thing to a firm and roomy condition in which it can stand, falling upon the whole social web and not upon the text alone, which is what the plural in "between the parties" discloses. And the close "Forgiving, Merciful" rather than "Hearing, Knowing" is a meant divergence: the alterer earns the close of surveillance, while the repairer earns the renewing cover of gh-f-r and the amplitude of r-ḥ-m that gathers what is inside it, because in his human reckoning there lies the chance of an error that needs a covering.

Celui qui remet en état est donc tenu de distinguer les deux avant d'agir, pour ne pas traiter celui qui a penché comme celui qui a voulu le tort.
La fāʾ de « et rétablit » est une fāʾ de succession immédiate : la remise en état suit droit sur le pressentiment du défaut, sans hâte et sans retard. Le noyau ṣ-l est une force qui tient ferme, et le ḥāʾ l'ouvre sur l'ampleur ; l'iṣlāḥ, à la racine, est le retour d'une chose à un état ferme et large où elle puisse se tenir, non un rapiéçage de surface. L'adverbe « entre » place l'acte dans l'espace où les parties tiennent les unes aux autres, et non dans le seul rapport de celui qui intervient au document. La négation, dans « ne porte aucun poids », porte sur le genre entier : elle lève toute mesure de tort de dessus celui qui remet en état, et non une part. Et la préposition de superposition, qui revenait dans le verset de l'altération pour porter l'installation d'une charge, reste présente ici par la négation : la charge ne s'est jamais posée. Puis la clôture est « couvrant, miséricordieux » et non « entendant, sachant », et l'écart est voulu : l'altérateur mérite une clôture de surveillance, et celui qui remet en état mérite une clôture de voile et d'ampleur. Le noyau gh-f est une couverture épaisse qui voile, et le rāʾ apporte le renouvellement et la reprise ; le ghafr est un voile refait sur ce qui a pu venir d'une appréciation fautive chez celui qui intervient lui-même. Et le noyau r-ḥ est une ampleur qui adhère, comme la matrice qui rassemble ce qu'elle porte, tandis que le mīm scelle le tassement.
Ainsi la parole précède le terme et le rôle précède l'identité. Le muṣliḥ n'est pas un titre mais un rôle, où tombe quiconque a vu un penchant ou une intention de tort dans un testament et s'est porté aussitôt à le ramener à l'équilibre, avant qu'une injustice écrite ne vienne se poser sur le dos des héritiers.
