﴾ Prescribed for you, when death has come to one of you and he has left behind good, is the written directive for the parents and the nearer relatives by what is recognized: a duty upon those who are building protection. ﴿
The verb "prescribed for you" comes back as it came in the ruling on the matched cost, and the repetition is no accident: the two verses speak of two acts that fall at the moment of death, the first an offence from outside and the second an ordering from within. Building the verb for the unnamed doer lifts the ruling to the station of a binding from above, with no need to name the binder. And the verbal form rather than the nominal, "was prescribed" and not "a prescription", gives an occurring and a sending down: the ruling came down as a descent, not as something already lying on them beforehand. And "for you" carries the ʿalā of binding from above, not accompaniment and not company: as though the matter lay heavy over them rather than open in their hands.
"When" is a locative of time giving the certainty of the occurrence and not its possibility: every human being reaches this station without fail. The verb "has come" is from the root ḥ-ḍ-r, whose nucleus is ḥ-ḍ, a living motion that shows, with the rāʾ sealing the drawing-out. So presence in the root is a coming that shows the present one in a scene that can be sensed. And death here is not described as having descended, nor as having arrived, nor as having come, but as having become present: it came and turned into a scene that is seen, marks on the body and on the soul. So the verse is not speaking of a death already fallen but of the moment its signs break out until it stands present in awareness. And "one of you" is from the root ʾ-ḥ-d, whose nucleus is ʾ-ḥ, an affirming within a limit. The single one in the root is a lone one likened to no other and gathered with no other. Choosing it in this station discloses the aloneness of every human being in his death: he dies alone and not with the group, and he is reckoned with alone. And there is a second alert: it does not read "death has come to you" but "has come to one of you", because death does not come upon a community all at once, it picks them out one by one.
"If" is a particle of condition giving possibility and not certainty. The difference between it and "when" is exact: "when" is for what falls without fail, as death does, and "if" is for what may fall or may not. So the coming of death takes "when" because it is certain, and the leaving of wealth takes "if" because it is not: a person may die and leave nothing behind. The root t-r-k has its nucleus in t-r, a completion that stretches, with the kāf sealing the hold. So leaving in the root is the quitting of a thing in such a way that it stays settled in its place after the going: not a neglect and not a loss but a deliberate keeping. The one who leaves goes, and what he left stays where it was. And "good" is a noun on the pattern faʿl in kh-y-r, given here to wealth, and it points at the settledness of the quality and not at its passing over. So the good is what is good in itself, not what its owner imagined to be good. And leaving it indefinite gives magnifying: a good of a weight worth counting. And the naming is striking: wealth here is called "good" and not "wealth", and this is a plain sign that wealth in itself is a candidate for being good if it was gathered from what is lawful and spent on what is due. Had the wealth been gathered from what is forbidden, calling it good would not hold, and it would not enter the condition the verse sets.
"The written directive" stands as the subject raised by the passive verb, and it is from the root w-ṣ-y, whose nucleus is w-ṣ, a joining that clings, with the yāʾ sealing the connection. So a directive in the root is a joining handed across time: what a man reaches his people with after his going. And the pattern faʿīla gives settledness: a directive is fixed and written, not a passing word. The lām in "for the parents" is a lām of assignment and not of full ownership: they are singled out for care, not made owners of everything. And "the parents" is a dual from the root w-l-d, whose nucleus is w-l, a joining that attaches, with the dāl sealing the pushing forth and the settling. So the parents in the root are the two sources of the joining from which the child issued, and the dual points at the origin of human connection. And "the nearer relatives" is a plural from the root q-r-b: the nearer ones are those whose descent has come close and whose tie is near. Putting the parents before the nearer relatives is a natural ordering in the degree of the tie. Then "by what is recognized", as in the verse of the matched cost: a social measure that stops both excess and stinting. Not one of them is deprived, and no one is directed more than the recognized standard of fairness will bear. And what is recognized here is a working arbiter between the nearer relatives and the one who directs, not the whim of the one who directs alone.
"A duty" is an infinitival noun affirming the content of the sentence before it, that is, this holds as a due indeed. The affirming noun fixes the ruling and lifts from it any suggestion of a recommendation or a figure: the directive is a due and not a piece of advice. The root ḥ-q-q has already been met: a tight and settled correspondence. So the due here is what matches the very substance of the matter and settles on it. And "upon" in "upon those who are building protection" is for binding: this due is laid upon them as a weight they carry. And singling out those who build protection does not mean that others are lifted out of the charge; it means that they alone are the ones who profit by the binding and rise to it. And this answers a surface reading that might arise: had the ruling been a general obligation, "a duty upon you" would have sufficed, but the singling out of those who build protection discloses that carrying the directive through calls for a will that guards against wronging the nearer relatives and against the greed of the heirs. Not everyone who knows a ruling acts on it, only whoever built his protection from himself first. And the sense is: the due is a due upon all, but its actual carrying falls on those who build protection.
The word precedes the term, and the role precedes the identity: "the one who directs" is not a title given to an owner of a fortune, it is a role that falls to whoever leaves a real good behind and reaches the parents and the nearer relatives with it by what is recognized, so that he rises to a due carried only by one who has built his protection against wronging his nearest and against the greed in himself.
The verse opens the door of the written directive with the same wording as the matched cost: "prescribed for you." The matched cost measured the limit of the outward answer, and the directive here opens the space of the inward ordering. The first condition comes with "when": "when death has come to one of you", and the verb, from ḥ-ḍ-r, gives a scene: death has not yet arrived, but its signs have turned into something that can be seen. The second condition comes with the possible "if": "and he has left behind good", and the wealth is named "good" and not "wealth", a sign that what was gathered from the forbidden does not deserve the name and so does not enter the condition of the verse. And the measure is "by what is recognized", the tight custom that wrongs no one. And the seal: "a duty upon those who are building protection." And singling out those who build protection, in the iftiʿāl of w-q-y, discloses that the ruling is general but that the one who actually carries it is whoever has built his protection against his own greed and against wronging his nearest.
﴾ Il vous est prescrit, quand la mort se présente à l'un de vous et qu'il a laissé un bien, de faire une disposition écrite pour les parents et les plus proches, selon l'usage : un droit à la charge des prémunis. ﴿
Le verbe « Il vous est prescrit » revient tel qu'il était venu dans la règle de la reprise équivalente, et cette reprise n'est pas fortuite : les deux versets parlent de deux actes qui tombent à l'instant de la mort, le premier une atteinte venue du dehors, le second une mise en ordre venue du dedans. La construction au passif hausse la prescription au rang d'une obligation posée d'en haut, sans qu'il faille nommer celui qui oblige. Et la forme verbale plutôt que la forme nominale, kutiba et non kitāb, donne un survenir et une descente : la prescription est descendue comme on fait descendre, elle ne reposait pas déjà sur eux auparavant. Et le ʿalā de « il vous est prescrit » est celui de l'obligation qui pèse d'en haut, non celui de l'accompagnement ni de la compagnie : comme si la chose était lourde au-dessus d'eux et non ouverte entre leurs mains.
« Quand » est un adverbe de temps qui donne la certitude de l'événement et non sa possibilité : tout être humain atteint cette station sans faute. Le verbe « se présente » est de la racine ḥ-ḍ-r, dont le noyau ḥ-ḍ est un mouvement vivant qui se montre, le rāʾ scellant l'étirement. La présence, dans la racine, est donc une venue qui donne à voir le présent dans une scène que les sens saisissent. Et la mort n'est dite ici ni descendue, ni arrivée, ni venue, mais présente : elle est venue et s'est faite scène visible, des marques sur le corps et sur l'âme. Le verset ne parle donc pas d'une mort déjà tombée, mais de l'instant où ses signes affleurent jusqu'à se tenir présents dans la conscience. Et « à l'un de vous » est de la racine ʾ-ḥ-d, dont le noyau ʾ-ḥ est une affirmation dans une limite ; l'unique, dans la racine, est un seul que rien ne compare et que rien ne rassemble à un autre. Le choisir en cette station découvre la solitude de chacun dans sa mort : il meurt seul et non avec le groupe, et seul il rend compte. Autre avertissement : il n'est pas dit « la mort vous est venue » mais « se présente à l'un de vous », car la mort ne prend pas une communauté en bloc, elle la cueille un par un.
« Et qu'il a laissé » porte in, particule de condition qui donne le possible et non le certain. La différence entre elle et idhā est exacte : idhā vaut pour ce qui tombe sans faute, comme la mort, et in pour ce qui peut tomber ou ne pas tomber. La venue de la mort prend donc idhā parce qu'elle est certaine, et le fait de laisser un bien prend in parce qu'il ne l'est pas : un homme peut mourir sans rien laisser. La racine t-r-k a pour noyau t-r, un achèvement qui s'étend, le kāf scellant la prise. Laisser, dans la racine, c'est quitter une chose de telle sorte qu'elle demeure établie à sa place après le départ : ni négligence ni perte, mais un maintien voulu. Celui qui laisse s'en va, et ce qu'il a laissé reste où il était. Et « un bien » est un nom sur le schème faʿl dans kh-y-r, donné ici à la richesse, et il marque la fixité de la qualité et non son passage. Le bien est donc ce qui est bien en soi, non ce que son détenteur a tenu pour un bien. Le laisser indéterminé donne l'amplification : un bien d'un poids qui compte. Et la nomination frappe : la richesse est ici appelée « bien » et non « richesse », signe net que la richesse est en elle-même candidate à être un bien si elle a été amassée de licite et dépensée dans le droit. Amassée d'illicite, elle ne mériterait pas ce nom et n'entrerait pas dans la condition que le verset pose.
« Une disposition écrite » tient la place du sujet que le verbe passif a élevé, et elle est de la racine w-ṣ-y, dont le noyau w-ṣ est une jonction qui adhère, le yāʾ scellant la liaison. Une disposition, dans la racine, est une jonction remise à travers le temps : ce par quoi un homme rejoint les siens après son départ. Et le schème faʿīla donne la fixité : une disposition est arrêtée et écrite, non une parole de passage. Le lām de « pour les parents » est un lām d'assignation et non de pleine propriété : ils sont désignés pour le soin, non faits propriétaires de tout. Et « les parents » est un duel de la racine w-l-d, dont le noyau w-l est une jonction qui s'attache, le dāl scellant la poussée et l'établissement ; les parents sont dans la racine les deux sources de la jonction d'où l'enfant a jailli, et le duel montre l'origine du lien humain. Et « les plus proches » est un pluriel de la racine q-r-b : les plus proches sont ceux dont la filiation s'est rapprochée et dont le lien est court. Placer les parents avant les plus proches est un ordre naturel dans le degré du lien. Puis « selon l'usage », comme dans le verset de la reprise équivalente : une mesure commune qui arrête l'excès autant que la lésine. Nul d'entre eux n'est privé, et nul ne reçoit plus que ce que l'usage tient pour équitable. Et l'usage est ici un arbitre en acte entre les plus proches et celui qui dispose, non le penchant de celui qui dispose laissé à lui seul.
« Un droit » est un nom d'action qui confirme le contenu de la phrase précédente, à savoir que cela vaut bien comme un dû. Le nom confirmatif fixe la prescription et lui ôte tout soupçon de recommandation ou de figure : la disposition est un droit et non un conseil. La racine ḥ-q-q a déjà été rencontrée : une correspondance serrée et fixée. Le droit est donc ici ce qui répond à la substance même de l'affaire et s'y établit. Et le « à la charge de » porte le ʿalā de l'obligation : ce droit est posé sur eux comme un poids qu'ils portent. Et désigner « les prémunis » ne lève pas les autres de la charge ; cela dit qu'eux seuls tirent profit de cette obligation et se lèvent pour elle. Cela répond d'ailleurs à une lecture de surface : si la prescription était une obligation générale, « un droit à votre charge » aurait suffi, mais la désignation des prémunis découvre que mener la disposition à terme demande une volonté qui se garde de léser les plus proches et de céder à l'avidité des héritiers. Tous ceux qui connaissent une règle ne l'appliquent pas ; seul l'applique celui qui a d'abord bâti sa prémunition contre lui-même. Le sens : le droit est un droit sur tous, mais sa portée effective tombe sur ceux qui bâtissent leur prémunition.
La parole précède le terme, et le rôle précède l'identité : celui qui dispose n'est pas un titre donné au détenteur d'une fortune, c'est un rôle qui échoit à quiconque laisse un bien véritable et rejoint par lui les parents et les plus proches selon l'usage, et se lève ainsi pour un droit que ne porte que celui qui a bâti sa prémunition contre la lésion des siens et contre l'avidité en lui-même.
