Commentary
The verse opens with innā, an emphasis spoken by the speaker in the plural, then anzalnā, "We have sent down", from n-z-l, a root that is something held within, pressed until it is ready to come out, and then flowing downward until it settles; anzala, on the pattern afʿala, makes the descent a deed that the speaker brings about on something else. Ilayka, "to you", fixes the end point: the Book reaches the one addressed himself. Al-kitāb, the Book, is from k-t-b, what is drawn together and fixed in its place so that it does not slip away, the root by which the hundred and third verse described the ṣalāt (the continuous connection): "a writing appointed to times".
Bi-l-ḥaqq, "with the truth", is the state of this sending down, and the bāʾ joins the Book and the truth, so the Book came down with the truth accompanying it. Al-ḥaqq is from ḥ-q-q: the fixing of a thing in its place so firmly that it does not budge. From it come ḥaqqa al-amr, the matter became firm and binding, and ḥaqīq bi-kadhā, bound to a thing and fit for it, as in ﴿حَقِيقٌ عَلَىٰ أَن لَّا أَقُولَ عَلَى اللَّهِ إِلَّا الْحَقَّ﴾, "bound not to say about Allah anything but the truth". The Book by which judgment is given carries in its descent what does not lean and does not shift, and on this fixed ground stands the judging that the verse names next.
The lām of li-taḥkuma, "that you may judge", makes judging the aim of the sending down. Judging, ḥukm, from ḥ-k-m, is holding a matter on its right course so that it does not slip away to another, so the one who judges holds what the disputants pull at and returns it to its place. "Between people" makes the field of judging people at large. Judging between people came in the fifty-eighth verse, ﴿وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُوا بِالْعَدْلِ﴾, "when you judge between people, to judge with evenness", a verse that opened with the delivery of trusts: ﴿أَن تُؤَدُّوا الْأَمَانَاتِ إِلَىٰ أَهْلِهَا﴾, "to deliver the things held in trust to their people".
Bi-mā arāka Allāh, "by what Allah has shown you", fixes what judgment is given by. Arāka is a verb from r-ʾ-y on the pattern afʿala, a root that is a perceiving that bursts out from readiness and falls on what is seen; arāhu al-shayʾa is to make someone see a thing, so the doer here is Allah, and the one addressed judges by a seeing that was given to him and that he did not make for himself. What he was shown stays undefined in mā, so it may hold what is in the Book sent down with the truth, and it may hold what the one addressed is made to see by it of the matter brought before him.
Then comes the prohibition: "do not be a disputant for the treacherous". Khaṣm, a party to a dispute, is from kh-ṣ-m: a gripping of one side of a matter, where the one who grips meets the one who grips its other side. From it come khuṣūma, contention and dispute, and in the Book, ﴿هَٰذَانِ خَصْمَانِ اخْتَصَمُوا فِي رَبِّهِمْ﴾, "these are two disputants who disputed about their Rabb (the Nurturing Sustainer)". Khaṣīman, on the pattern faʿīl, is one to whom disputing clings and who takes it up, and the lām of li-l-khāʾinīna makes the disputing on their behalf, so what is forbidden is that the one addressed become a party carrying their side. The hundred and seventh verse spells out this lām with another particle, ﴿وَلَا تُجَادِلْ عَنِ الَّذِينَ يَخْتَانُونَ أَنفُسَهُمْ﴾, "do not argue on behalf of those who betray themselves", where ʿan is a standing in the place of the one defended.
Al-khāʾinūn, the treacherous, is from kh-w-n, a root that is a lack running through the inside of what a person was entrusted with while its surface stands. From it comes ﴿يَعْلَمُ خَائِنَةَ الْأَعْيُنِ وَمَا تُخْفِي الصُّدُورُ﴾, "He knows the stealing of the eyes and what the breasts conceal", the khāʾina there being what the gaze steals in secret. Al-khāʾinīn is an active participle in the plural, so the verse names them by a trait fixed in them, and the hundred and seventh verse returns to the same root twice, "who betray themselves" and khawwānan, "much given to betrayal". Betrayal is the opposite of the trust with which the fifty-eighth verse opened the matter of judging between people: there the Surah joined judging to the delivery of trusts, and here it forbids the one who judges to stand up for those who break them.
The verse opens with the sending down of the Book to the one addressed together with the truth, the truth being what is fixed in its place and does not budge, and it makes the aim of the sending down a judging that holds the matter between people on its right course, its measure being what Allah has shown the one addressed, a seeing given to him whose wording may hold what is in the Book and what he is made to see by it. It then forbids him to be a disputant for the treacherous, a party gripping their side, the treacherous being people in whom a lack runs through the inside of what they were entrusted with. The judging that the Surah joined to the delivery of trusts is guarded here from the other side: from the one who judges becoming a disputant on behalf of the one who betrays.
Commentaire
Le verset s'ouvre sur innā, une insistance que prononce celui qui parle au pluriel, puis anzalnā, « Nous avons fait descendre », de n-z-l, une racine qui est une chose contenue au-dedans, pressée jusqu'à être prête à sortir, puis coulant vers le bas jusqu'à se poser ; anzala, sur le schème afʿala, fait de la descente un acte que celui qui parle porte sur autre chose que lui. Ilayka, « vers toi », fixe le point d'arrivée : le Livre atteint celui-là même à qui la parole s'adresse. Al-kitāb, le Livre, vient de k-t-b, ce qui est rassemblé et fixé à sa place pour ne pas s'échapper, la racine par laquelle le cent troisième verset a décrit la ṣalāt (la liaison continue) : « une écriture fixée à des temps ».
Bi-l-ḥaqq, « avec la vérité », est l'état de cette descente, et le bāʾ joint le Livre et la vérité : le Livre est descendu accompagné de la vérité. Al-ḥaqq vient de ḥ-q-q : le fait qu'une chose soit fixée à sa place si fermement qu'elle ne bouge pas. De là viennent ḥaqqa al-amr, l'affaire est devenue ferme et obligatoire, et ḥaqīq bi-kadhā, tenu à une chose et digne d'elle, comme dans ﴿حَقِيقٌ عَلَىٰ أَن لَّا أَقُولَ عَلَى اللَّهِ إِلَّا الْحَقَّ﴾, « tenu de ne dire sur Allāh que la vérité ». Le Livre par lequel on juge porte dans sa descente ce qui ne penche pas et ne se déplace pas, et sur ce sol fixe se tient le jugement que le verset nomme ensuite.
Le lām de li-taḥkuma, « pour que tu juges », fait du jugement le but de la descente. Juger, ḥukm, de ḥ-k-m, c'est tenir une affaire sur sa juste voie pour qu'elle ne s'échappe pas vers une autre ; celui qui juge retient donc ce que tirent les parties en litige et le ramène à sa place. « Entre les gens » fait des gens en général le champ du jugement. Le jugement entre les gens est venu au cinquante-huitième verset, ﴿وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُوا بِالْعَدْلِ﴾, « quand vous jugez entre les gens, de juger avec équité », un verset qui s'ouvrait sur la remise des dépôts : ﴿أَن تُؤَدُّوا الْأَمَانَاتِ إِلَىٰ أَهْلِهَا﴾, « de remettre les dépôts confiés à leurs gens ».
Bi-mā arāka Allāh, « par ce qu'Allāh t'a fait voir », fixe ce par quoi l'on juge. Arāka est un verbe de r-ʾ-y sur le schème afʿala, une racine qui est une perception jaillissant d'une disposition prête et tombant sur ce qui est vu ; arāhu al-shayʾa, c'est faire voir une chose à quelqu'un : l'auteur est ici Allāh, et celui à qui la parole s'adresse juge par une vision qui lui a été donnée et qu'il ne s'est pas faite lui-même. Ce qu'on lui a fait voir reste indéterminé dans mā, si bien qu'il peut contenir ce qui est dans le Livre descendu avec la vérité, et qu'il peut contenir ce que celui à qui la parole s'adresse est amené à voir, par lui, de l'affaire qui lui est présentée.
Vient alors la défense : « ne sois pas un plaideur pour les traîtres ». Le khaṣm, partie à un litige, vient de kh-ṣ-m : une prise sur un côté d'une affaire, où celui qui saisit rencontre celui qui saisit l'autre côté. De là viennent khuṣūma, la querelle et le litige, et dans le Livre, ﴿هَٰذَانِ خَصْمَانِ اخْتَصَمُوا فِي رَبِّهِمْ﴾, « voici deux parties qui se sont querellées au sujet de leur Rabb (Celui qui fait croître et veille) ». Khaṣīman, sur le schème faʿīl, est celui à qui la querelle s'attache et qui s'en charge, et le lām de li-l-khāʾinīna fait du litige une plaidoirie en leur faveur : ce qui est défendu, c'est que celui à qui la parole s'adresse devienne une partie portant leur côté. Le cent septième verset explicite ce lām par une autre particule, ﴿وَلَا تُجَادِلْ عَنِ الَّذِينَ يَخْتَانُونَ أَنفُسَهُمْ﴾, « ne dispute pas en faveur de ceux qui se trahissent eux-mêmes », où ʿan est une manière de se tenir à la place de celui que l'on défend.
Les traîtres, al-khāʾinūn, viennent de kh-w-n, une racine qui est un manque courant à l'intérieur de ce qui a été confié à quelqu'un tandis que la surface tient debout. De là vient ﴿يَعْلَمُ خَائِنَةَ الْأَعْيُنِ وَمَا تُخْفِي الصُّدُورُ﴾, « Il connaît la dérobade des yeux et ce que cachent les poitrines », la khāʾina y étant ce que le regard dérobe en secret. Al-khāʾinīn est un participe actif au pluriel : le verset les nomme par un trait fixé en eux, et le cent septième verset revient deux fois à la même racine, « qui se trahissent eux-mêmes » et khawwānan, « grand traître ». La trahison est le contraire du dépôt confié par lequel le cinquante-huitième verset a ouvert l'affaire du jugement entre les gens : là, la sourate a joint le jugement à la remise des dépôts, et ici elle défend à celui qui juge de se lever pour ceux qui les violent.
Le verset s'ouvre sur la descente du Livre vers celui à qui la parole s'adresse, accompagné de la vérité, la vérité étant ce qui est fixé à sa place et ne bouge pas, et il fait du but de cette descente un jugement qui tient l'affaire entre les gens sur sa juste voie, sa mesure étant ce qu'Allāh a fait voir à celui à qui la parole s'adresse, une vision donnée dont la formulation peut contenir ce qui est dans le Livre et ce qu'il est amené à voir par lui. Il lui défend ensuite d'être un plaideur pour les traîtres, une partie qui saisit leur côté, les traîtres étant des gens chez qui un manque court à l'intérieur de ce qui leur a été confié. Le jugement que la sourate a joint à la remise des dépôts est ainsi gardé de l'autre côté : que celui qui juge ne devienne pas le plaideur de celui qui trahit.

القراءة الشائعة
تُنقَلُ الآيةُ عادةً في واقِعةِ سَرِقة: رَجُلٌ سَرَقَ مَتاعاً ورَمى بِسَرِقَتِه رَجُلاً بَريئاً، وفي بَعضِ الرِّواياتِ أنَّ البَريءَ رَجُلٌ من اليَهود، وجاءَ قَومُ السّارِقِ إلى النَّبيِّ يُجادِلونَ عَنه ويَشهَدونَ لَه بِالبَراءة، فنَزَلَتِ الآيةُ وما بَعدَها تَنهى عن الخِصامِ عن الخائن. و«بِما أراكَ الله» عِندَهُم: بِما أوحى إلَيكَ وعَلَّمَك، ويُذكَرُ فيها الخِلافُ في أن يَكونَ الحُكمُ بِالوَحيِ وَحدَه أو بِما يُؤَدّي إلَيه النَّظَرُ فيه.
قراءةٌ تَضَعُ الآيةَ في واقِعةٍ بِعَينِها، وتَجعَلُ ما أُريَه المُخاطَبُ وَحياً وتَعليماً.
قراءةٌ تُصغي إلى الجذر
«أنزَلنا» (ن-ز-ل): مَكنونٌ يُرسَلُ من عُلُوٍّ حتّى يَستَقِرّ. و«الحَقّ» (ح-ق-ق): ثُبوتُ الشَّيءِ في مَقَرِّه ثُبوتاً لا يَتَزَحزَح. و«لِتَحكُمَ» (ح-ك-م): إمساكُ الأمرِ على وَجهِه. و«أراكَ» (ر-أ-ي): رُؤيةٌ تَنبَثِقُ من تَأَهُّبٍ فتَقَعُ على المَرئيّ. و«الخائنين» (خ-و-ن): نَقصٌ يَسري في باطِنِ الأمانةِ وظاهِرُها قائم. و«خَصيماً» (خ-ص-م): قَبضٌ على جانِبٍ من الأمرِ في مُواجَهةِ جانِبِه الآخَر. فالآيةُ: «إنّا أرسَلنا إلَيكَ من عُلُوٍّ الكِتابَ المُثبَتَ، مُلتَبِساً بِالثّابِتِ الذي لا يَتَزَحزَح، لِتُمسِكَ الأمرَ بَينَ النّاسِ على وَجهِه بِما جَعَلَكَ اللهُ تَراه، ولا تَكُنْ لِمَن يَنقُضونَ الأمانةَ في الخَفاءِ طَرَفاً يَقبِضُ على جانِبِهِم».
قراءةٌ تَسمَعُ الحُكمَ رُؤيةً أُعطِيَت، يُحفَظُ صاحِبُها من أن يَصيرَ جانِباً يُؤخَذ.
القراءتان لا تَتعارَضان: الأُولى تَضَعُ الآيةَ في واقِعةٍ بِعَينِها وتَحكي ما نُقِلَ في «أراكَ»، والثانيةُ تَسمَعُ في الجُذورِ كِتاباً يَنزِلُ ومَعَه الثّابِت، وحُكماً يُمسِكُ الأمرَ بِرُؤيةٍ أُعطِيَت، ونَهياً عن القَبضِ على جانِبِ الخائن. هذا الكتابُ يَختارُ الإصغاءَ الإضافيّ.
Two Readings
Common reading
The verse is usually read in connection with a theft: a man stole some goods and cast the theft on an innocent man, in some accounts a Jewish man, and the thief's people came to the Prophet arguing on his behalf and vouching for his innocence, whereupon this verse and those after it came down, forbidding pleading for the one who betrays. "By what Allah has shown you" is taken to mean by what He revealed to you and taught you, and the verse is cited in the disagreement over whether judging is by revelation alone or also by what reflection upon it leads to.
A reading that sets the verse in a particular incident and makes what the one addressed was shown a revelation and a teaching.
A root-reading
Anzalnā (root n-z-l): something held within, sent from a height until it settles. Al-ḥaqq (root ḥ-q-q): the fixing of a thing in its place so firmly that it does not budge. Li-taḥkuma (root ḥ-k-m): holding a matter on its right course. Arāka (root r-ʾ-y): a seeing that bursts out from readiness and falls on what is seen. Al-khāʾinīn (root kh-w-n): a lack running through the inside of a trust while its surface stands. Khaṣīman (root kh-ṣ-m): a gripping of one side of a matter over against its other side. The verse becomes: "We have sent to you from on high the Book that is fixed, joined to what is firm and does not budge, so that you may hold the matter between people on its right course by what Allah has made you see; do not be, for those who break a trust in secret, a party gripping their side."
A reading that hears judging as a seeing that was given, whose holder is kept from becoming a side that is taken.
The two readings do not conflict. The first sets the verse in a particular incident and relates what was handed down about "shown you"; the second hears, in the roots, a Book coming down with what is firm, a judging that holds the matter by a seeing that was given, and a prohibition of gripping the side of the one who betrays. This book chooses the additional listening.
Deux Lectures
Lecture courante
Le verset est d'ordinaire lu en lien avec un vol : un homme déroba des biens et fit retomber le vol sur un innocent, un Juif selon certains récits, et les gens du voleur vinrent auprès du Prophète plaider pour lui en attestant son innocence ; ce verset et ceux qui le suivent seraient alors descendus, défendant de plaider pour celui qui trahit. « Par ce qu'Allāh t'a fait voir » est compris comme : par ce qu'Il t'a révélé et enseigné, et l'on cite le verset dans le désaccord sur la question de savoir si l'on juge par la seule révélation ou aussi par ce à quoi conduit la réflexion sur elle.
Une lecture qui place le verset dans un incident particulier et fait de ce qu'on a fait voir à celui à qui la parole s'adresse une révélation et un enseignement.
Une lecture à la racine
Anzalnā (racine n-z-l) : une chose contenue au-dedans, envoyée d'une hauteur jusqu'à ce qu'elle se pose. Al-ḥaqq (racine ḥ-q-q) : le fait qu'une chose soit fixée à sa place si fermement qu'elle ne bouge pas. Li-taḥkuma (racine ḥ-k-m) : tenir une affaire sur sa juste voie. Arāka (racine r-ʾ-y) : une vision qui jaillit d'une disposition prête et tombe sur ce qui est vu. Al-khāʾinīn (racine kh-w-n) : un manque courant à l'intérieur d'un dépôt tandis que sa surface tient debout. Khaṣīman (racine kh-ṣ-m) : une prise sur un côté d'une affaire, face à son autre côté. Le verset devient : « Nous t'avons envoyé d'en haut le Livre fixé, joint à ce qui est ferme et ne bouge pas, pour que tu tiennes l'affaire entre les gens sur sa juste voie par ce qu'Allāh t'a fait voir ; ne sois pas, pour ceux qui violent un dépôt en secret, une partie qui saisit leur côté. »
Une lecture qui entend le jugement comme une vision donnée, dont le détenteur est gardé de devenir un côté que l'on prend.
Les deux lectures ne s'opposent pas. La première place le verset dans un incident particulier et rapporte ce qui a été transmis sur « t'a fait voir » ; la seconde entend, dans les racines, un Livre qui descend avec ce qui est ferme, un jugement qui tient l'affaire par une vision donnée, et la défense de saisir le côté de celui qui trahit. Ce livre choisit l'écoute supplémentaire.
«إِنَّا أَنزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ»: كِتابٌ يَنزِلُ ومَعَه الثّابِت
تَفتَتِحُ الآيةُ بِـ«إنّا»، تَوكيداً يَصدُرُ عن المُتَكَلِّمِ بِضَميرِ الجَمع، ثُمَّ «أنزَلنا» من ن-ز-ل، والجِذرُ مَكنونٌ يُضغَطُ فيَتَهَيَّأُ لِلخُروجِ ثُمَّ يَنسابُ إلى أسفَلَ حتّى يَستَقِرّ، و«أنزَلَ» على أفعَلَ يَجعَلُ النُّزولَ فِعلاً يُوقِعُه المُتَكَلِّمُ بِغَيرِه. و«إلَيكَ» تُعَيِّنُ المُنتَهى: الكِتابُ يَبلُغُ المُخاطَبَ نَفسَه. و«الكِتاب» من ك-ت-ب، ما ضُمَّ فأُثبِتَ في مَوضِعِه فلا يَتَفَلَّت، وهو الجِذرُ الذي وَصَفَت بِه الآيةُ الثّالِثةُ بَعدَ المِئةِ الصَّلاةَ: «كِتاباً مَوقوتاً».
و«بِالحَقّ» حالُ هذا الإنزال، والباءُ تُلابِسُ بَينَ الكِتابِ والحَقّ، فالكِتابُ نَزَلَ والحَقُّ مَعَه. والحَقُّ من ح-ق-ق، ثُبوتُ الشَّيءِ في مَقَرِّه ثُبوتاً لا يَتَزَحزَح، ومنه «حَقَّ الأمرُ» ثَبَتَ ووَجَب، و«حَقيقٌ بِكذا» لازِمٌ لَه جَديرٌ بِه، كما في ﴿حَقِيقٌ عَلَىٰ أَن لَّا أَقُولَ عَلَى اللَّهِ إِلَّا الْحَقَّ﴾. فالكِتابُ الذي يُحكَمُ بِه يَحمِلُ في نُزولِه ما لا يَميلُ ولا يَتَحَوَّل، وعلى هذا الثّابِتِ يَقومُ الحُكمُ الذي تَذكُرُه الآيةُ بَعدَه.
«لِتَحْكُمَ بَيْنَ النَّاسِ بِمَا أَرَاكَ اللَّهُ»: حُكمٌ بِما أُري
واللّامُ في «لِتَحكُمَ» تَجعَلُ الحُكمَ غايةَ الإنزال. والحُكمُ من ح-ك-م، إمساكُ الأمرِ على وَجهِه حتّى لا يَنفَلِتَ إلى غَيرِه، فالحاكِمُ يُمسِكُ ما تَنازَعَه المُتَنازِعونَ ويَرُدُّه إلى مَوضِعِه. و«بَينَ النّاس» تَجعَلُ مَجالَ الحُكمِ النّاسَ عامّة. وقد جاءَ الحُكمُ بَينَ النّاسِ في الآيةِ الثّامِنةِ والخَمسين: ﴿وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُوا بِالْعَدْلِ﴾، وقد افتُتِحَت تِلكَ الآيةُ بِأداءِ الأمانات: ﴿أَن تُؤَدُّوا الْأَمَانَاتِ إِلَىٰ أَهْلِهَا﴾.
و«بِما أراكَ الله» تُعَيِّنُ ما يُحكَمُ بِه. و«أراكَ» فِعلٌ من ر-أ-ي على أفعَل، والجِذرُ إدراكٌ يَنبَثِقُ من تَأَهُّبٍ فيَقَعُ على ما يُرى، و«أراه الشَّيءَ» جَعَلَه يَراه، فالفاعِلُ هُنا الله، والمُخاطَبُ يَحكُمُ بِرُؤيةٍ أُعطِيَها ولم يَصنَعْها لِنَفسِه. ويَبقى ما أُرِيَه مُبهَماً في «ما»، فيَحتَمِلُ ما في الكِتابِ الذي نَزَلَ بِالحَقّ، ويَحتَمِلُ ما يُبصِرُه المُخاطَبُ بِه من أمرِ ما يُعرَضُ عَلَيه.
«وَلَا تَكُن لِّلْخَائِنِينَ خَصِيمًا»: خُصومةٌ تُحمَلُ عن خائن
ثُمَّ يَأتي النَّهي: «ولا تَكُنْ لِلخائنينَ خَصيماً». والخَصمُ من خ-ص-م، قَبضٌ على جانِبٍ من أمرٍ يَلتَقي فيه القابِضُ بِمَن يَقبِضُ على جانِبِه الآخَر، ومنه «الخُصومة» الجَدَلُ والمُنازَعة، وفي الكِتابِ ﴿هَٰذَانِ خَصْمَانِ اخْتَصَمُوا فِي رَبِّهِمْ﴾. و«خَصيماً» على فَعيل، مَن تَلزَمُه الخُصومةُ ويَقومُ بِها، واللّامُ في «لِلخائنين» تَجعَلُ الخُصومةَ لِأجلِهِم، فالمَنهِيُّ عَنه أن يَصيرَ المُخاطَبُ طَرَفاً يَحمِلُ جانِبَهُم. وتُفَسِّرُ الآيةُ السّابِعةُ بَعدَ المِئةِ هذه اللّامَ بِحَرفٍ آخَر: ﴿وَلَا تُجَادِلْ عَنِ الَّذِينَ يَخْتَانُونَ أَنفُسَهُمْ﴾، و«عن» فيها قِيامٌ في مَوضِعِ المُدافَعِ عَنه.
والخائنونَ من خ-و-ن، والجِذرُ نَقصٌ يَسري في باطِنِ ما اؤتُمِنَ عَلَيه المَرءُ وظاهِرُه قائم، ومنه ﴿يَعْلَمُ خَائِنَةَ الْأَعْيُنِ وَمَا تُخْفِي الصُّدُورُ﴾، والخائنةُ فيها ما يُسارَقُ من النَّظَرِ في خَفاء. و«الخائنين» اسمُ فاعِلٍ مَجموع، فالآيةُ تُسَمّيهِم بِصِفةٍ ثَبَتَت فيهِم، وتَعودُ الآيةُ السّابِعةُ بَعدَ المِئةِ إلى الجِذرِ نَفسِه مَرَّتَين: «يَختانونَ أنفُسَهُم» و«خَوّاناً». والخِيانةُ نَقيضُ الأمانةِ التي افتَتَحَت بِها الآيةُ الثّامِنةُ والخَمسونَ أمرَ الحُكمِ بَينَ النّاس، فالسّورةُ قَرَنَت هُناكَ الحُكمَ بِأداءِ الأمانات، وتَنهى هُنا عن أن يَقومَ الحاكِمُ لِمَن يَنقُضُها.
حَصيلة
تَفتَتِحُ الآيةُ بِإنزالِ الكِتابِ إلى المُخاطَبِ مُلتَبِساً بِالحَقّ، والحَقُّ ثابِتٌ في مَقَرِّه لا يَتَزَحزَح، وتَجعَلُ غايةَ الإنزالِ حُكماً يُمسِكُ الأمرَ بَينَ النّاسِ على وَجهِه، ومِقياسُه ما أراه اللهُ لِلمُخاطَب، رُؤيةً أُعطِيَها يَحتَمِلُ لَفظُها ما في الكِتابِ وما يُبصِرُه بِه. ثُمَّ تَنهاه عن أن يَكونَ لِلخائنينَ خَصيماً، طَرَفاً يَقبِضُ على جانِبِهِم، والخائنونَ قَومٌ يَسري النَّقصُ في باطِنِ ما اؤتُمِنوا عَلَيه. فالحُكمُ الذي قَرَنَته السّورةُ بِأداءِ الأماناتِ يُحفَظُ هُنا من الجِهةِ الأُخرى: أن يَصيرَ صاحِبُه خَصماً عن الخائن.
تحليل جذريّ
«أَنزَلْنَا» جذر: ن-ز-ل
ن (الاحتواءُ والاحتباسُ الجوفيّ) + ز (التضاغطُ والاكتنازُ في المضيق): النواةُ نز = مُحتَوىً يُضغَطُ في مَضيقٍ فيَتَهَيَّأُ لِأن يَخرُج. ثمّ ل (الامتداد والانسياب والانتشار) تُرسِلُه مُنساباً إلى ما تَحتَه حتّى يَبلُغَ مَقَرَّه. فالجذرُ ن-ز-ل حرفيّاً ما كانَ مَكنوناً في عُلُوٍّ يُرسَلُ إلى أسفَلَ حتّى يَستَقِرّ. ومنه «نَزَلَ» هَبَطَ وحَلّ، و«النُّزُل» ما يُهَيَّأُ لِلنّازِلِ حينَ يَحُلّ. و«أنزَلنا إلَيكَ» في الآيةِ إنزالٌ على أفعَلَ فاعِلُه المُتَكَلِّم، و«إلى» تَجعَلُ مُنتَهاه المُخاطَبَ نَفسَه.
«بِالْحَقِّ» جذر: ح-ق-ق
ح (التضييقُ والاحتواءُ في الباطن) + ق (العقد والالتئام في العمق): النواةُ حق = احتِواءٌ ضَيِّقٌ يَنعَقِدُ في العُمقِ فيَستَحكِمُ فيه. ثمّ ق (الاحتباس والاشتداد) مُكَرَّرةً تَشُدُّ هذا الانعِقادَ فلا يَنحَلّ. فالجذرُ ح-ق-ق حرفيّاً ثُبوتُ الشَّيءِ في مَقَرِّه ثُبوتاً لا يَتَزَحزَح. ومنه «حَقَّ الأمرُ» ثَبَتَ ووَجَب، و«الحَقّ» ما ثَبَتَ فلا يُدفَع، و«حَقيقٌ بِكذا» لازِمٌ لَه جَديرٌ بِه. و«بِالحَقّ» في الآيةِ حالُ الإنزال: الكِتابُ نَزَلَ مُلابِساً لِما ثَبَتَ في مَقَرِّه، ولِذلك يَصلُحُ أن يُحكَمَ بِه.
«لِتَحْكُمَ» جذر: ح-ك-م
ح (التضييقُ والاحتواءُ في الباطن) + ك (الكتمُ والاحتباسُ والامتساك): النواةُ حك = تَضييقٌ يَحتَوي الشَّيءَ ويَحبِسُه عن الانفِلات. ثمّ م (الضمُّ واللقاءُ والتلاصق) تَضُمُّ المَحبوسَ إلى مَوضِعِه فيَلزَمُه. فالجذرُ ح-ك-م حرفيّاً إمساكُ الأمرِ على وَجهِه حتّى لا يَنفَلِتَ إلى غَيرِه. ومنه «الحُكم» الفَصلُ الذي يَقطَعُ النِّزاع، و«الحاكِم» مَن يُمسِكُ بَينَ المُتَنازِعَينِ فيَكُفُّ أحَدَهُما عن الآخَر، و«أحكَمَ الشَّيءَ» أتقَنَه. و«لِتَحكُمَ بَينَ النّاس» في الآيةِ غايةُ الإنزال، والفَصلُ فيها مَبسوطٌ على النّاسِ عامّةً، وما يُمسَكُ بِه الأمرُ هو ما أراه اللهُ لِلمُخاطَب.
«أَرَاكَ» جذر: ر-أ-ي
ر (الجريانُ المسترسِل) + أ (الاحتباسُ والضغطُ والتهيّؤ): النواةُ رأ = جريانٌ ينبثقُ حادًّا من تهيُّؤٍ محتبِس. ثمّ ي (امتداد + لِين + سَريان) في آخِرِ الجِذرِ مَدٌّ يَحمِلُ هذا الانبِثاقَ إلى ما يَقَعُ عَلَيه، ولا تَقومُ عَلَيه النَّواة. فالجذرُ ر-أ-ي حرفيّاً إدراكٌ يَنطَلِقُ من تَأَهُّبٍ فيَقَعُ على المَرئيّ. ومنه «رَأى» أبصَرَ أو عَلِم، و«الرَّأي» ما يَنتَهي إلَيه النَّظَرُ في الأمر، و«أراه الشَّيءَ» جَعَلَه يَراه. و«بِما أراكَ اللهُ» في الآيةِ رُؤيةٌ فاعِلُها الله، يُعطاها المُخاطَبُ فيَحكُمُ بِها.
«لِّلْخَائِنِينَ» جذر: خ-و-ن
خ (التخلخلُ والنقصُ والفراغ) + ن (الاحتواءُ والاحتباسُ الجوفيّ): الجِذرُ أجوَفُ حَرفاه الصَّحيحانِ الخاءُ والنّون، والنواةُ مِنهُما خن = تَخَلخُلٌ يُنقِصُ ما يَحتَويه الجَوفُ من داخِلِه. وو (الوصل الممدود والربط) بَينَهُما مَدٌّ يَحمِلُ هذا النَّقصَ ويَمُدُّه خَفِيّاً، ولا تَقومُ عَلَيه النَّواة. فالجذرُ خ-و-ن حرفيّاً نَقصٌ يَسري في باطِنِ ما اؤتُمِنَ عَلَيه المَرءُ وظاهِرُه قائم. ومنه «الخِيانة» نَقضُ الأمانةِ في خَفاء، و«خانَه» نَقَصَه حَقَّه وهو آمِنٌ لَه، و«خائنةُ الأعيُن» ما يُسارَقُ من النَّظَر. و«لِلخائنين» في الآيةِ جَمعُ اسمِ فاعِلٍ ثَبَتَت فيهِم الصِّفة، وتَعودُ الآيةُ السّابِعةُ بَعدَ المِئةِ إلى الجِذرِ على الافتِعالِ «يَختانون» ثُمَّ على المُبالَغةِ «خَوّاناً».
«خَصِيمًا» جذر: خ-ص-م
خ (الاختراقُ والنفوذُ الجاري) + ص (الإطباقُ الصلبُ والإمساك): النواةُ خص = نُفوذٌ يَختَرِقُ إلى شَيءٍ بِعَينِه فيُطبِقُ عَلَيه ويُمسِكُه دونَ غَيرِه. ثمّ م (الضمُّ واللقاءُ والتلاصق) تُلقي هذا المُمسِكَ بِمَن يُقابِلُه فيَلتَقِيان. فالجذرُ خ-ص-م حرفيّاً قَبضٌ على جانِبٍ من أمرٍ يَلتَقي فيه القابِضُ بِمَن يَقبِضُ على جانِبِه الآخَر. ومنه «الخُصومة» المُنازَعةُ في الحَقّ، و«الخَصم» المُنازِع، يُقالُ لِلواحِدِ والجَماعة، و«خُصْمُ الوِعاءِ» جانِبُه وزاوِيَتُه. و«خَصيماً» في الآيةِ على فَعيل، مَن يَلزَمُ الخُصومةَ ويَقومُ بِها، واللّامُ في «لِلخائنين» تَجعَلُه قائماً بِها لِأجلِهِم.
التَّأويل
أوّلاً: ما تَقولُهُ الحروف
الإنزالُ من ن-ز-ل مَكنونٌ يُرسَلُ من عُلُوٍّ حتّى يَستَقِرّ، والحَقُّ من ح-ق-ق ثُبوتٌ في المَقَرِّ لا يَتَزَحزَح، والحُكمُ من ح-ك-م إمساكُ الأمرِ على وَجهِه، والرُّؤيةُ من ر-أ-ي إدراكٌ يَنطَلِقُ من تَأَهُّبٍ فيَقَعُ على المَرئيّ، والخِيانةُ من خ-و-ن نَقصٌ يَسري في باطِنِ الأمانة، والخُصومةُ من خ-ص-م قَبضٌ على جانِبٍ من الأمر. فالحُروفُ تُقَدِّمُ الرُّؤيةَ على القَبض: يُرى الأمرُ أوَّلاً بِما أُري، ثُمَّ يُمسَكُ على وَجهِه، وتُنهى اليَدُ عن القَبضِ على جانِبِ الخائنين.
ثانياً: المَشهَد
كِتابٌ يَنزِلُ إلى واحِدٍ ومَعَه الثّابِت، ثُمَّ يَجلِسُ هذا الواحِدُ بَينَ النّاسِ لِيَحكُم، وفي يَدِه رُؤيةٌ أُعطِيَها. وبَينَ مَن يَقِفونَ أمامَه قَومٌ نَقَصوا ما اؤتُمِنوا عَلَيه وظاهِرُهُم قائم، والآيةُ تُمسِكُ الحاكِمَ في مَوضِعِه: يَحكُمُ بِما أُري، ولا يَكونُ لِهؤلاءِ خَصيماً يَقبِضُ على جانِبِهِم.
ثالثاً: النَّمَطُ الذي قد يتكرر في اي زمان ومكان
مَن أخَذَ جانِباً قَبلَ أن يَرى رَأى الأمرَ من جانِبِه، فالخُصومةُ إذا سَبَقَت إلى المَرءِ صَبَغَت ما يَراه. والآيةُ تَجعَلُ ما أُرِيَه الحاكِمُ مِقياسَ الحُكم، وتَنهاه عن أن يَكونَ خَصيماً لِلخائنين، فتَحفَظُ رُؤيَتَه من أن تَميلَ بِه الخُصومة. ويَتَكَرَّرُ النَّمَطُ في كُلِّ مَجلِسٍ يُفصَلُ فيه بَينَ مُتَنازِعَين: كُلَّما صارَ الفاصِلُ طَرَفاً لِأحَدِهِما ضاقَ ما يَراه من الحَقِّ بِقَدرِ ما اتَّسَعَ ما يَحمِلُه من جانِبِه.
رابعاً: تخمينات وإسقاطات أنثروبولوجيّة
قد يُوازي هذا ما وَجَدَه جورج لوينستاين (George Loewenstein) ولِندا بابكوك (Linda Babcock) وزُمَلاؤهُما في تَجارِبَ على التَّفاوُضِ بُنِيَت على قَضيّةِ تَعويضٍ حَقيقيّةٍ عن حادِثِ سَير. ففي تَجرِبَتِهِمُ الأولى (1993) وُزِّعَ المُشارِكون، وهُم طُلّابٌ جامِعيّونَ وطُلّابُ قانون، عَشوائيّاً على دَورِ المُدَّعي ودَورِ المُدَّعى عَلَيه، وقَرَأَ الفَريقانِ الأوراقَ نَفسَها من مَلَفِّ القَضيّة، ثُمَّ طُلِبَ من كُلٍّ مِنهُم أن يُقَدِّرَ ما حَكَمَ بِه قاضٍ قَرَأَ الأوراقَ نَفسَها، ووُعِدَ بِمُكافأةٍ إن اقتَرَبَ تَقديرُه من الحُكم. فجاءَ تَقديرُ المُدَّعينَ أعلى من تَقديرِ المُدَّعى عَلَيهِم بِنَحوِ أربَعةَ عَشَرَ ألفاً وخَمسِمِئةِ دولارٍ في المُتَوَسِّط، وقد قَرَأَ الجَميعُ الأوراقَ نَفسَها. ورُبَّما كانَ في قَولِه «بِما أراكَ الله» ثُمَّ «ولا تَكُنْ لِلخائنينَ خَصيماً» ما يُشبِهُ هذا: الجانِبُ الذي يُؤخَذُ يَصبُغُ الرُّؤية، فجاءَ النَّهيُ عن أخذِه لِيَبقى الحُكمُ بِما أُري.
وفي تَجرِبةٍ تاليةٍ نُشِرَت سَنةَ 1995 عَرَفَ بَعضُ المُشارِكينَ دَورَهُم بَعدَ أن قَرَأوا القَضيّةَ وقَدَّروا حُكمَ القاضي، وعَرَفَه آخَرونَ قَبلَ القِراءة، فكانَت نِسبةُ الأزواجِ التي عَجَزَت عن الاتِّفاقِ وتُرِكَ أمرُها لِحُكمِ القاضي سِتّةً في المِئةِ عِندَ الأوَّلين، وثَمانيةً وعِشرينَ في المِئةِ عِندَ الآخَرين. ولَعَلَّ تَرتيبَ الآيةِ، رُؤيةً أوَّلاً ثُمَّ نَهياً عن الخُصومة، يَقَعُ على هذا المَوضِعِ نَفسِه: أن يَسبِقَ النَّظَرُ في الأمرِ أخذَ الجانِبِ فيه.
Interpretation
First: what the letters say
Sending down (n-z-l) is something held within, sent from a height until it settles; ḥaqq (ḥ-q-q) is a fixing in its place that does not budge; ḥukm (ḥ-k-m) is holding a matter on its right course; seeing (r-ʾ-y) is a perceiving that sets out from readiness and falls on what is seen; betrayal (kh-w-n) is a lack running through the inside of a trust; disputing (kh-ṣ-m) is a gripping of one side of a matter. The letters set the seeing before the gripping: the matter is first seen by what was shown, then held on its course, and the hand is forbidden to grip the side of the treacherous.
Second: the scene
A Book comes down to one person with what is firm accompanying it; that person then sits among people to judge, holding a seeing that was given to him. Among those who stand before him are people who have hollowed out what they were entrusted with while their surface stands, and the verse holds the judge in his place: he judges by what he was shown, and does not become for them a disputant gripping their side.
Third: the pattern that may recur in any time and place
Whoever takes a side before seeing sees the matter from his side, so that disputing, when it reaches a person first, colors what he sees. The verse makes what the judge was shown the measure of judgment and forbids him to be a disputant for the treacherous, keeping his seeing from being bent by the dispute. The pattern recurs wherever someone decides between two parties: the more the one deciding becomes a party to one of them, the narrower grows what he sees of the truth, in the measure that what he carries of his side grows wider.
Fourth: anthropological speculations and projections
This may parallel what George Loewenstein, Linda Babcock and their colleagues found in bargaining experiments built on a real claim for damages after a road accident. In their first experiment (1993) the participants, undergraduates and law students, were randomly assigned the role of plaintiff or defendant; both sides read the same pages from the case file, and each was then asked to estimate the award made by a judge who had read the same pages, with a bonus if the estimate came close. The plaintiffs' estimates came out on average about 14,500 dollars higher than the defendants', though all had read the same pages. Perhaps "by what Allah has shown you", followed by "do not be a disputant for the treacherous", holds something like this: the side one takes colors the seeing, so the forbidding of taking it keeps the judgment to what was shown.
In a later experiment, published in 1995, some participants learned their role after reading the case and estimating the judge's award, and others learned it before reading; the share of pairs that failed to agree and left the matter to the judge's award was 6 percent among the first and 28 percent among the second. The verse's order, seeing first and then the forbidding of the disputant's part, may fall on this very point: that looking into the matter should come before taking a side in it.
Interprétation
Premièrement: ce que disent les lettres
Faire descendre (n-z-l), c'est une chose contenue au-dedans, envoyée d'une hauteur jusqu'à ce qu'elle se pose ; le ḥaqq (ḥ-q-q) est une fixation à sa place qui ne bouge pas ; le ḥukm (ḥ-k-m) est tenir une affaire sur sa juste voie ; voir (r-ʾ-y) est une perception qui part d'une disposition prête et tombe sur ce qui est vu ; trahir (kh-w-n) est un manque courant à l'intérieur d'un dépôt ; le litige (kh-ṣ-m) est une prise sur un côté d'une affaire. Les lettres placent la vision avant la prise : l'affaire est d'abord vue par ce qu'on a fait voir, puis tenue sur sa voie, et il est défendu à la main de saisir le côté des traîtres.
Deuxièmement: la scène
Un Livre descend vers une personne, accompagné de ce qui est ferme ; cette personne s'assied ensuite parmi les gens pour juger, tenant une vision qui lui a été donnée. Parmi ceux qui se tiennent devant elle se trouvent des gens qui ont vidé de l'intérieur ce qui leur avait été confié tandis que leur surface tient debout, et le verset retient le juge à sa place : il juge par ce qu'on lui a fait voir, et ne devient pas pour eux un plaideur qui saisit leur côté.
Troisièmement: le motif qui peut se répéter en tout temps et tout lieu
Qui prend un côté avant de voir voit l'affaire depuis son côté, si bien que le litige, quand il atteint quelqu'un en premier, teinte ce qu'il voit. Le verset fait de ce qu'on a fait voir au juge la mesure du jugement et lui défend d'être un plaideur pour les traîtres, gardant sa vision d'être courbée par le litige. Le motif se répète partout où quelqu'un tranche entre deux parties : plus celui qui tranche devient la partie de l'une d'elles, plus se rétrécit ce qu'il voit de la vérité, à mesure que s'élargit ce qu'il porte de son côté.
Quatrièmement: spéculations et projections anthropologiques
Cela pourrait rejoindre ce qu'ont trouvé George Loewenstein, Linda Babcock et leurs collègues dans des expériences de négociation construites sur une véritable demande d'indemnisation après un accident de la route. Dans leur première expérience (1993), les participants, des étudiants de premier cycle et des étudiants en droit, ont été répartis au hasard entre le rôle du demandeur et celui du défendeur ; les deux côtés ont lu les mêmes pages du dossier, puis chacun a dû estimer l'indemnité fixée par un juge qui avait lu les mêmes pages, avec une prime si l'estimation en approchait. Les estimations des demandeurs sont ressorties en moyenne supérieures d'environ 14 500 dollars à celles des défendeurs, alors que tous avaient lu les mêmes pages. Peut-être « par ce qu'Allāh t'a fait voir », suivi de « ne sois pas un plaideur pour les traîtres », porte-t-il quelque chose de cela : le côté que l'on prend teinte la vision, et la défense de le prendre garde le jugement à ce qu'on a fait voir.
Dans une expérience ultérieure, publiée en 1995, certains participants ont appris leur rôle après avoir lu l'affaire et estimé l'indemnité du juge, et d'autres l'ont appris avant la lecture ; la part des paires qui n'ont pu s'accorder et ont laissé l'affaire à l'indemnité du juge était de 6 pour cent chez les premiers et de 28 pour cent chez les seconds. L'ordre du verset, la vision d'abord puis la défense de tenir le rôle de plaideur, pourrait tomber sur ce point même : que l'examen de l'affaire précède la prise de parti.
