﴾ O you who have believed, prescribed for you is tracking back the matched cost in cases of killing: the free for the free, the slave for the slave, and the female for the female. But whoever is given any forgiveness by his brother, then a following-up by what is recognized and a payment to him with generosity. That is a lightening from your Lord and a mercy. Whoever transgresses after that, for him is painful punishment. ﴿
The call "O you who have believed" is set apart for the believers, and the link is made by a verb rather than by a noun, so the address comes down on those who have realized the act of belief and not on those attached to it by an inherited name. The choice is exact: the ruling on tracking back the matched cost is a load only one whose religion has become an act can carry. The verb "prescribed" is built for the unnamed doer, and that build lifts the ruling to the station of a binding from above without naming the binder, since the binder is known from the setting. The root k-t-b has its nucleus in k-t, a holding that settles, and the bāʾ seals it into showing. So writing in the making of its root is a holding made visible and fixed, and from there a book is a book because it shuts meaning inside a tracing that stays. And "for you" carries the ʿalā of overhang, a binding that falls above the will, so the writing here is an imposition and not a choice. The noun "tracking back the matched cost" is on the pattern fiʿāl, and fiʿāl gives a doing between two parties. The root q-ṣ-ṣ has its nucleus in q-ṣ, a cut made tight, and the doubled ṣād doubles the tightness. So in the root it is the following of a track by its like, followed tightly, as one says of a man that he tracked a trail step by step. It is not the answering of an act at any price, it is the following of an act by its like in an exact balance. And "in cases of killing" carries a fī of abstract place: in their matter and their case, not in their bodies. And "the killed" is a plural on the pattern faʿlā, the plural Arabic keeps for afflictions and conditions, so it points at a shared state and not merely at a count of individuals.
The three nouns stand in apposition to "tracking back the matched cost", or as the predicate of an omitted subject, and the sense is that a free person is matched by a free person, a slave by a slave, a female by a female. The bāʾ in each is the bāʾ of setting-against and not of adhesion: it sets one side opposite another, as one says "I paid a dinar for a dinar", that is, over against it. Why the detail? Because the threefold matching places a ceiling on the claim and cuts the escalation: a life for a life, no more. And no licence for moral ranking follows from it; what follows is the blocking of the paths to escalation: the highest limit of the claim is the like, not double and not multiples. The setting-against bāʾ puts one side opposite one side, so no more than one may be demanded for one. It fixes the upper ceiling of the claim, not the lower floor.
The fāʾ here is a fāʾ of detail and branching: after the rule is stated, the excepted case is told. "Is given forgiveness" is built for the unnamed doer from the root ʿ-f-w, whose nucleus is ʿ-f, an appearing that comes loose. Forgiveness in the root is an effacing that releases the offender from the consequence of his offence, and not a spoken indulgence. From it the Arabs say the winds effaced the traces, when they carried them off until nothing of them was left. The lām in "given to him" is a lām of assignment: the forgiveness belongs to this person and to no other. And "by his brother" is where the astonishment sits: the one who killed the forgiver's kin is called his brother. This is no figure of speech and no softening of language, it is a deep legislation made in a word: the brotherhood of faith is not severed by blood, and forgiveness restores the tie the criminal act cut. Had the brotherhood been cut by the killing, the wording would have been "from his fellow" or "from his adversary". Using the word "his brother" in this place in particular discloses an intent: forgiveness is an act of recovering the brotherhood the killing broke, and not an indulgence shown to an enemy. And "any" is indefinite for the general: any measure of forgiveness, little or much, carries the case out of the stage of the matched cost into the stage of compensation.
The answer of the condition, "a following-up", is an infinitival noun in the nominative as the predicate of an omitted subject, that is, "then its ruling is a following-up". Choosing the noun rather than the verb fixes what is asked as a settled attribute and not a passing event. And "following-up" is of the iftiʿāl pattern in t-b-ʿ, and that pattern carries the taking of trouble and the pursuit of the act. The root t-b-ʿ has its nucleus in t-b, a completion that clings, and the ʿayn seals it into showing. So following in the root is a laboured coming-after that completes the motion without a break. What is meant here is that the one holding the claim of blood, having forgiven, binds himself to pursue the payment in the recognized way, asking nothing above it and squeezing nobody. And "by what is recognized" is from ʿ-r-f, whose nucleus is ʿ-r, an appearing that stretches, with the fāʾ sealing the separation. So what is recognized in the root is what the community has come to know and has settled on together: the tight custom that wrongs no one. Then the joining, "and a payment to him with generosity": the root ʾ-d-y has its nucleus in ʾ-d, an affirming that settles, with the yāʾ as connection to the end. So payment in the root is a full delivery to the destination with nothing short. And the facing of the two sides is finely made: the first, the holder of the claim, follows up by what is recognized; the second, the offender or his people, pays with generosity. Following-up is a custom that adds nothing; payment is a generosity that adds to the beauty of the discharge. And the root ḥ-s-n in generosity is a beauty that shows and gleams, so paying is not enough on its own, the beauty of the paying is required with it: generosity in the payment answers the forgiveness on the facing side.
"That" points at the opening of forgiveness and compensation, not at the matched cost itself. The predicate "a lightening" is from the root kh-f-f, whose nucleus is kh-f, a going out that comes loose, and the doubled fāʾ doubles the loosening. So lightening in the root is the taking away of what weighs until it comes off its bearer. "From your Lord" attaches to the lightening, and the lordship here is meant and not merely a name: the Lord is the one who raises and sets right, so the lightening is part of a raising that lifts the weight which used to rule in the custom of vengeance. And the joining of "and a mercy" affirms the sense in a second layer: a lightening on the side of the act, a mercy on the side of the aim. Then the closing sentence, "Whoever transgresses after that, for him is painful punishment": the verb is of the iftiʿāl pattern from ʿ-d-w, and that pattern carries the labour of crossing over, the deliberate pursuit of passing the limit. The sense is that whoever accepted the forgiveness and the compensation and then went back to demanding blood, or exacted the matched cost and then reached past the killer to another, has entered into aggression against the ruling itself and not only against his adversary. And the painful punishment here resumes the punishment named a few verses back: the pattern faʿīl is an assimilated adjective giving the settledness of the pain inside the punishment itself, not something that came over it.
The word precedes the term, and the role precedes the identity: "brother" is not a title granted on agreement and stripped on disagreement, it is a role that forgiveness gives back after the break. Calling the offender a brother inside the sentence of forgiveness opens the severed tie again, and makes the matched cost a limit that breaks the vengeance rather than a bridge to a new one.

Si la fraternité avait été coupée par le meurtre, la formule aurait été « de son compagnon » ou « de son adversaire ». Employer le mot « son frère » à cet endroit précis découvre une visée : la remise est un acte qui recouvre la fraternité que le meurtre a brisée, et non une complaisance envers un ennemi. Et « une part » est indéfini pour le général : toute mesure de remise, petite ou grande, fait passer l'affaire de l'étape de la reprise à celle du dédommagement.

Et le vis-à-vis des deux côtés est finement fait : le premier, tenant du droit, suit selon l'usage ; le second, celui qui a tué ou les siens, règle avec bel accomplissement. La suite est un usage qui n'ajoute rien ; le règlement est une beauté qui ajoute à la manière de s'acquitter. Et la racine ḥ-s-n dans le bel accomplissement est une beauté qui paraît et qui luit : payer ne suffit donc pas, la beauté du paiement est requise avec lui, car la beauté dans le règlement répond à la remise du côté d'en face.
« Cela » désigne l'ouverture de la remise et du dédommagement, non la reprise elle-même. Le prédicat « un allègement » vient de la racine kh-f-f, dont le noyau est kh-f, une sortie qui se détache, et le fāʾ redoublé redouble le détachement. Alléger, à la racine, est ôter ce qui pèse jusqu'à ce que cela se détache de celui qui le portait. « De votre Nourricier » se rattache à l'allègement, et la mention du Nourricier est ici voulue et non un simple nom : le Nourricier est celui qui fait croître et qui redresse, si bien que l'allègement fait partie d'une croissance qui lève le poids que l'usage de la vengeance faisait régner. Et la jonction « et une miséricorde » affirme le sens par une seconde couche : l'allègement du côté de l'acte, la miséricorde du côté de la visée. Puis la phrase finale, « mais celui qui outrepasse après cela encourt un châtiment douloureux » : le verbe est du schème iftiʿāl, de ʿ-d-w, schème qui porte la peine prise à franchir, la poursuite délibérée du dépassement de la limite. Le sens est que celui qui a accepté la remise et le dédommagement puis est revenu réclamer le sang, ou celui qui a exercé la reprise puis l'a portée au-delà de celui qui a tué, est entré en agression contre le jugement lui-même et non contre son seul adversaire. Et le châtiment douloureux reprend ici le châtiment nommé quelques versets plus haut : le schème faʿīl est un adjectif assimilé qui donne la fixité de la douleur dans le châtiment même, et non quelque chose qui lui serait survenu.
La parole précède le terme, et le rôle précède l'identité : « frère » n'est pas un titre accordé sur l'accord et retiré sur le désaccord, c'est un rôle que la remise rend après la brisure. Appeler « frère » celui qui a tué, à l'intérieur même de la phrase de la remise, rouvre le lien tranché, et fait de la reprise équivalente une limite qui brise la vengeance et non un pont vers une vengeance nouvelle.
