﴾ O you who have given trust, it is not lawful for you to inherit women against their will (karhan). Do not hold them in straits (ʿaḍl) so as to go off with part of what you have given them, unless they come with a manifest fāḥisha. Live with them in companionship in the recognized way (maʿrūf). If you dislike them, it may be that you dislike a thing and Allah places in it much good. ﴿
This is the first call in the Surah to "those who have given trust" (alladhīna āmanū); the Surah opened with a call to "people", and the address has moved from the shared origin to a group known by what it did: it gave trust. Īmān is from ʾ-m-n, and those who have given trust are people who gave their trust and so became a place of safety for those around them, so the call under this description sets the prohibition that follows within what people ought to be safe from at their hands, and in the verse the women are the ones this safety concerns. The prohibition then comes as lā yaḥillu, "it is not lawful". Ḥill is from ḥ-l-l, whose core is the untying of a knot, so what "is lawful" is what the knot of prohibition has been untied from and left free, and what "is not lawful" stays knotted in prohibition.
What is forbidden is "that you inherit women". Inheriting (irth) is from w-r-th, the passing of what remains of the dead to the one who comes after him. This root came in the verses on inheritance as the verb of the heir, with the mother among the heirs, ﴿وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ﴾, "and his two parents inherit from him, then his mother has a third", and those verses gave women shares: ﴿وَلِلنِّسَاءِ نَصِيبٌ مِّمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ﴾, "and for women a share of what parents and the nearest kin leave". Here it comes with the women as what the act falls on, and the verse forbids moving a woman from one who holds a share in the estate to a thing counted within it. The woman in the Surah is an heir with an appointed share, and the verse keeps this place for her and forbids her being reckoned among what is left behind.
Karhan, "against their will", describes the forbidden inheriting by its manner: that it fall on the woman while she is unwilling. Karh is from k-r-h, what the self finds heavy on it, so it shrinks from it and pushes it away; the verse makes the woman's will present in the ruling and names what is done to her against her will by the name of karh. The same root returns at the end of the verse attributed to the men, "if you dislike them" (fa-in kariḥtumūhunna), so the verse begins with the woman's aversion and ends with the man's, and gives each of them a ruling.
A second prohibition follows: "do not hold them in straits" (wa-lā taʿḍulūhunna). ʿAḍl is from ʿ-ḍ-l, confining and constricting until getting out becomes hard; one says ʿaḍalat al-marʾa bi-waladihā when a woman's child is hard to deliver, al-dāʾ al-ʿuḍāl is the disease that resists and does not come loose, and ʿaḍala is packed, tight-bound flesh, a muscle. ʿAḍl, then, is that a woman be pressed and confined until her way out grows narrow. The same verb occurs in the Book in forbidding that released women be kept from returning to their husbands, ﴿فَلَا تَعْضُلُوهُنَّ أَن يَنكِحْنَ أَزْوَاجَهُنَّ﴾, "do not hold them back from marrying their husbands", and here it is joined to a different purpose.
The purpose is "so as to go off with part of what you have given them"; the li- gives the reason for the constricting by what is sought through it, and dhahaba bi-l-shayʾ is to take a thing and go off with it. "What you have given them" leads back to the command at the opening of the Surah, ﴿وَآتُوا النِّسَاءَ صَدُقَاتِهِنَّ نِحْلَةً﴾, "give the women their marriage gifts as a free gift", so the gift that was given purely, with no return sought, is to be partly recovered by pressure. That verse opened a single door through which something of it could come back, the pleasure of the woman's own self; constricting is a road to the same thing from the opposite door: a narrowness manufactured until the woman gives up part of her due to get out of it.
Then comes the exception: "unless they come with a manifest fāḥisha" (illā an yaʾtīna bi-fāḥishatin mubayyina). The verb yaʾtīna is the very verb of the verse of holding, except that there it fell on "the fāḥisha", definite, with no particle, and here it falls on "a fāḥisha", indefinite, through bi-, described as mubayyina, that is, evident, making itself plain. The two verses require evidence in whatever is built on a fāḥisha: there, through the testimony of four; here, through a description that makes it plain in itself. The exception attaches to the prohibition of constricting and lifts it in this case alone, and what lies beyond its lifting the verse leaves open.
After two prohibitions comes a command: "live with them in companionship in the recognized way" (wa-ʿāshirūhunna bi-l-maʿrūf). Muʿāshara is from ʿ-sh-r, a root that turns on a group whose members mix with one another; from it come ʿashīra, the clan of people who mix, and ʿashīr, the companion who keeps close. The verb is on the reciprocal pattern (mufāʿala), so companionship is an act exchanged between two, and the woman in it is a party who keeps company as she is kept company. Maʿrūf is from ʿ-r-f, what people have come to know, so that their selves are at rest with it and they do not reject it, and the bi- makes it accompany the companionship in all its states. Having forbidden that a woman be treated as property to be inherited, and that she be pressed to give back what she was given, the verse describes what takes their place: a shared life accompanied by what people recognize and accept.
The root k-r-h then returns, having passed from the woman to the man: "if you dislike them". The answer is fa-ʿasā, "it may be", a verb of hope that opens the matter onto a possibility that has not yet come about, and shayʾan, "a thing", is indefinite and makes the saying wider than the woman alone: it is a ruling on all that is disliked, and the woman then falls within it. "Allah places in it much good": the placing is fīhi, "in it", in the very thing disliked, so the good is set inside what is disliked. Khayr is from kh-y-r, what is chosen for its benefit and whose effect passes into its owner, and its description as kathīran, "much", magnifies what Allah places there.
Elsewhere a construction close to this occurs: ﴿وَعَسَىٰ أَن تَكْرَهُوا شَيْئًا وَهُوَ خَيْرٌ لَّكُمْ﴾, "it may be that you dislike a thing while it is good for you". There the good is a description of the thing itself; here it is a good that Allah places in it, so the good in the verse on women is an act of Allah renewed within what is disliked. The verb yajʿala is the verb of the verse of holding, "or Allah makes a way for them", so in both verses Allah makes what those addressed do not possess: a way for the women held, and good within what is disliked.
The first call in the Surah to "those who have given trust" comes with a prohibition against treating women as property that is inherited: "it is not lawful", from ḥ-l-l, a knot still tied in prohibition; "that you inherit", from w-r-th, an act that gave women a share in the verses on inheritance and is here forbidden to fall on them; and "against their will", from k-r-h, a manner that makes the woman's will the seat of the ruling. Constricting is then forbidden, from ʿ-ḍ-l, a pressure meant to make the woman return part of what she was given purely, and the exception to the prohibition is a "manifest" fāḥisha, which requires evidence as the testimony of four required it. In place of all this comes a command to keep company, from ʿ-sh-r, a companionship exchanged between the two and accompanied by the maʿrūf, from ʿ-r-f. The verse closes with the man's dislike, sets "it may be" before him, and makes good, from kh-y-r, a thing that Allah places inside what is disliked, with the same verb by which He makes a way for the women held in the verse of holding.
﴾ Ô vous qui avez donné confiance, il ne vous est pas licite d'hériter des femmes contre leur gré (karhan). Ne les tenez pas à l'étroit (ʿaḍl) pour emporter une part de ce que vous leur avez donné, à moins qu'elles ne viennent avec une fāḥisha manifeste. Vivez avec elles en compagnie selon le maʿrūf (le convenable reconnu). Si vous les avez en aversion, il se peut que vous ayez en aversion une chose et qu'Allāh y place un bien abondant. ﴿
C'est le premier appel de la sourate à « ceux qui ont donné confiance » (alladhīna āmanū) ; la sourate s'est ouverte sur un appel aux « gens », et l'adresse est passée de l'origine commune à un groupe connu par ce qu'il a fait : il a donné confiance. L'īmān vient de ʾ-m-n, et ceux qui ont donné confiance sont des gens qui ont accordé leur confiance et sont ainsi devenus un lieu de sécurité pour ceux qui les entourent, si bien que l'appel sous cette qualité place l'interdit qui suit dans ce dont les gens devraient être à l'abri de leur part, et dans le verset ce sont les femmes que cette sécurité concerne. L'interdit vient alors sous la forme lā yaḥillu, « il n'est pas licite ». Le ḥill vient de ḥ-l-l, dont le fond est le dénouement d'un nœud : ce qui « est licite » est ce dont le nœud de l'interdit a été défait et qui est laissé libre, et ce qui « n'est pas licite » reste noué dans l'interdit.
Ce qui est interdit, c'est « que vous héritiez des femmes ». L'héritage (irth) vient de w-r-th, le passage de ce qui reste du mort à celui qui vient après lui. Cette racine est venue dans les versets de l'héritage comme verbe de l'héritier, la mère comptant parmi les héritiers, ﴿وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ﴾, « et ses deux parents héritent de lui, alors à sa mère le tiers », et ces versets ont donné aux femmes des parts : ﴿وَلِلنِّسَاءِ نَصِيبٌ مِّمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ﴾, « et aux femmes une part de ce que laissent les père et mère et les plus proches ». Elle vient ici avec les femmes pour objet de l'acte, et le verset interdit de faire passer une femme de celle qui détient une part de la succession à une chose comptée en elle. La femme, dans la sourate, est une héritière dotée d'une part fixée, et le verset lui garde cette place et interdit qu'elle soit comptée parmi ce qui est laissé.
Karhan, « contre leur gré », décrit l'héritage interdit par sa manière : qu'il tombe sur la femme alors qu'elle y répugne. Le karh vient de k-r-h, ce que l'âme trouve pesant pour elle, si bien qu'elle s'en rétracte et le repousse ; le verset rend la volonté de la femme présente dans la règle et nomme ce qu'on lui fait contre sa volonté du nom de karh. La même racine revient à la fin du verset, attribuée aux hommes, « si vous les avez en aversion » (fa-in kariḥtumūhunna), si bien que le verset commence par l'aversion de la femme et finit par celle de l'homme, et donne à chacune une règle.
Vient un second interdit : « ne les tenez pas à l'étroit » (wa-lā taʿḍulūhunna). Le ʿaḍl vient de ʿ-ḍ-l, enfermer et resserrer jusqu'à ce que sortir devienne difficile ; on dit ʿaḍalat al-marʾa bi-waladihā quand l'enfant d'une femme a peine à sortir, al-dāʾ al-ʿuḍāl est la maladie rebelle qui ne se dénoue pas, et la ʿaḍala est une chair tassée et serrée, un muscle. Le ʿaḍl est donc qu'une femme soit pressée et enfermée jusqu'à ce que son issue se rétrécisse. Le même verbe se trouve dans le Livre pour interdire que des femmes répudiées soient empêchées de retourner à leurs maris, ﴿فَلَا تَعْضُلُوهُنَّ أَن يَنكِحْنَ أَزْوَاجَهُنَّ﴾, « ne les empêchez pas d'épouser leurs maris », et il est ici joint à une autre fin.
La fin est « pour emporter une part de ce que vous leur avez donné » ; le li- donne la raison du resserrement par ce qu'on en attend, et dhahaba bi-l-shayʾ, c'est prendre une chose et s'en aller avec elle. « Ce que vous leur avez donné » ramène à l'ordre de l'ouverture de la sourate, ﴿وَآتُوا النِّسَاءَ صَدُقَاتِهِنَّ نِحْلَةً﴾, « donnez aux femmes leurs dons de mariage en don gracieux », si bien que le don fait purement, sans contrepartie demandée, est en partie repris par la pression. Ce verset avait ouvert une seule porte par laquelle quelque chose en pouvait revenir, le bon gré de l'âme de la femme ; le resserrement est une route vers la même chose par la porte opposée : une étroitesse fabriquée jusqu'à ce que la femme cède une part de son dû pour en sortir.
Vient alors l'exception : « à moins qu'elles ne viennent avec une fāḥisha manifeste » (illā an yaʾtīna bi-fāḥishatin mubayyina). Le verbe yaʾtīna est celui-là même du verset de la rétention, sauf que là il portait sur « la fāḥisha », définie, sans particule, et qu'ici il porte sur « une fāḥisha », indéfinie, par bi-, qualifiée de mubayyina, c'est-à-dire évidente, qui se rend claire. Les deux versets exigent l'évidence dans ce que l'on bâtit sur une fāḥisha : là, par le témoignage de quatre ; ici, par une qualification qui la rend claire en elle-même. L'exception se rattache à l'interdit du resserrement et le lève dans ce seul cas, et ce qui s'étend au-delà de cette levée, le verset le laisse ouvert.
Après deux interdits vient un ordre : « vivez avec elles en compagnie selon le maʿrūf » (wa-ʿāshirūhunna bi-l-maʿrūf). La muʿāshara vient de ʿ-sh-r, une racine qui tourne autour d'un groupe dont les membres se mêlent les uns aux autres ; de là viennent ʿashīra, le clan des gens qui se mêlent, et ʿashīr, le compagnon qui se tient près. Le verbe est sur le schème réciproque (mufāʿala) : la compagnie est un acte échangé entre deux, et la femme y est une partie qui tient compagnie comme on lui tient compagnie. Le maʿrūf vient de ʿ-r-f, ce que les gens en sont venus à connaître, si bien que leurs âmes s'y reposent et qu'ils ne le rejettent pas, et le bi- le fait accompagner la compagnie dans tous ses états. Après avoir interdit qu'une femme soit traitée comme un bien dont on hérite, et qu'elle soit pressée de rendre ce qu'on lui a donné, le verset décrit ce qui en tient lieu : une vie partagée qu'accompagne ce que les gens reconnaissent et agréent.
La racine k-r-h revient alors, passée de la femme à l'homme : « si vous les avez en aversion ». La réponse est fa-ʿasā, « il se peut », un verbe d'espérance qui ouvre l'affaire sur une possibilité qui n'est pas encore advenue, et shayʾan, « une chose », est indéfini et rend la parole plus large que la seule femme : c'est une règle portant sur tout ce qui est en aversion, et la femme y entre ensuite. « Qu'Allāh y place un bien abondant » : le placement est fīhi, « en elle », dans la chose même qu'on a en aversion, si bien que le bien est posé à l'intérieur de ce qu'on répugne. Le khayr vient de kh-y-r, ce que l'on choisit pour son profit et dont l'effet passe en son possesseur, et sa qualification par kathīran, « abondant », grandit ce qu'Allāh y place.
Ailleurs se trouve une construction proche de celle-ci : ﴿وَعَسَىٰ أَن تَكْرَهُوا شَيْئًا وَهُوَ خَيْرٌ لَّكُمْ﴾, « il se peut que vous ayez en aversion une chose alors qu'elle est un bien pour vous ». Là, le bien est une qualité de la chose même ; ici, c'est un bien qu'Allāh place en elle, si bien que le bien, dans le verset sur les femmes, est un acte d'Allāh renouvelé à l'intérieur de ce qu'on répugne. Le verbe yajʿala est celui du verset de la rétention, « ou qu'Allāh leur fasse un chemin », si bien que, dans les deux versets, Allāh fait ce que ceux à qui l'on s'adresse ne possèdent pas : un chemin pour les femmes retenues, et un bien dans ce qu'on répugne.
Le premier appel de la sourate à « ceux qui ont donné confiance » vient avec un interdit : traiter les femmes comme un bien dont on hérite. « Il n'est pas licite », de ḥ-l-l, un nœud resté noué dans l'interdit ; « que vous héritiez », de w-r-th, un acte qui a donné aux femmes une part dans les versets de l'héritage et qu'il est ici interdit de faire porter sur elles ; « contre leur gré », de k-r-h, une manière qui fait de la volonté de la femme le siège de la règle. Le resserrement est ensuite interdit, de ʿ-ḍ-l, une pression destinée à faire rendre à la femme une part de ce qui lui fut donné purement, et l'exception à l'interdit est une fāḥisha « manifeste », qui exige l'évidence comme l'exigeait le témoignage de quatre. À la place de tout cela vient l'ordre de tenir compagnie, de ʿ-sh-r, une compagnie échangée entre les deux et accompagnée du maʿrūf, de ʿ-r-f. Le verset se clôt sur l'aversion de l'homme, place devant lui « il se peut », et fait du bien, de kh-y-r, une chose qu'Allāh place à l'intérieur de ce qu'on répugne, par le même verbe par lequel Il fait un chemin pour les femmes retenues dans le verset de la rétention.
